These SMS Terms of Service (“SMS Terms”) govern the text message (SMS) program operated by Evident Inc. (operating as “EviSmart,” “we,” “us,” or “our”). By opting in to receive text messages from us, you agree to these SMS Terms.
- Program Name: EviSmart SMS
- Program description. When you opt in, we will send recurring marketing and/or service text messages — such as product announcements, offers, events, and service updates — to the mobile number you provide.
- Message types:
- Marketing messages: By opting-in, you consent to receiving marketing text messages including but not limited to: promotional materials, sales information, product updates, and content. You may opt out of these communications at any time by following the unsubscribe instructions provided in the messages, or by contacting EviSmart directly.
- Service messages: By opting-in, you consent to receiving service text messages including but not limited to: outages, customer support, policy updates, etc... You may opt out of these communications at any time by following the unsubscribe instructions provided in the messages, or by contacting EviSmart directly.
- Consent: We send text messages only to individuals who have expressly opted in — for example, by checking the SMS consent box on our website form. Opting in is optional and is never a condition of creating an account or purchasing any goods or services.
- Eligibility: Our text messaging program is available to recipients with mobile numbers in the United States and Canada.
- Message frequency: You may receive up to [8] messages per month. Message frequency may vary.
- Opt-out: You can cancel at any time by replying STOP to any message. After you reply STOP, we will send a one-time confirmation, and you will no longer receive text messages from the program. To rejoin, opt in again.
- Help: Reply HELP for assistance, or contact us at support@evidentdigital.com.
- Carriers: Carriers are not liable for delayed or undelivered messages.
- Privacy: Your information is handled in accordance with our Privacy Policy. No mobile phone numbers, SMS opt-in data, or consent records will be shared, sold, or rented to third parties, affiliates, or non-affiliates for marketing or promotional purposes. We share this data only with authorized aggregators and service providers on our behalf, strictly to transmit these communications.
- Changes: We may update these SMS Terms from time to time. Changes are effective when posted to this page.
